1031 Exchanges

Keep Your Investment Capital Working

For investors selling appreciated real estate, a Section 1031 like-kind exchange can be an extremely valuable planning tool.

When properly structured, a qualifying 1031 exchange may allow an investor to defer recognition of capital gain by exchanging real property held for investment or business purposes for other qualifying investment or business real property.

Instead of immediately recognizing the entire gain from a sale, an investor may be able to keep more of that capital invested in real estate.

1031 exchanges involve strict rules and deadlines, so planning before the sale is critical.

Selling One Property and Buying Another

This is where having a real estate team experienced with investment transactions becomes particularly valuable.

Selling your existing investment. We help determine market value, prepare and professionally market the property, evaluate offers, negotiate the transaction, and work toward a successful closing.

Finding the replacement property. At the same time, we can begin searching for potential replacement properties based on your investment goals, desired return, property type, price range, and preferred market.

Timing matters. In a typical deferred 1031 exchange, replacement property generally must be identified within 45 days after transferring the relinquished property and received within 180 days or the applicable tax-return deadline, whichever comes first.

Because those deadlines can move quickly, we believe the replacement-property search should begin well before closing whenever possible.

    Because tax situations vary, you should have your CPA, attorney, and/or Qualified Intermediary determine whether a particular transaction qualifies.
  • When should I start planning a 1031 exchange?

    Ideally, before your existing investment property is sold.

    The deadlines after closing can be extremely short, particularly the 45-day replacement-property identification period. Starting the conversation early allows us to begin evaluating replacement properties and coordinating with the professionals handling your exchange.
  • Can your property management company manage a property I buy?

    Yes. Our sister company, Volare Properties, provides professional property management services for rental property owners, including leasing, maintenance coordination, reporting, tenant relations, and other day-to-day property management functions.
